PEB Appointed for Rail National Labor Bargaining

Date
Jul 18, 2022

Dear BNSF Customers,

I want to update you on the status of the railroad industry's labor negotiations. As I wrote to you last month, we do not yet have agreements with all of our unions in the current bargaining round.

Before the close of the initial cooling-off period, President Biden appointed a Presidential Emergency Board (PEB) on July 15, 2022. This action effectively extends the period during which no strikes or other self-help is allowed for another 60 days. The PEB will hold hearings in the coming weeks and issue recommendations mid-August. Although the PEB recommendations are not binding, they have historically assisted parties in reaching voluntary agreements.

We will continue to engage constructively in this process and inform you of significant developments. Please contact your marketing representative if you have any questions.

Sincerely,

Steve Bobb
Executive Vice President and Chief Marketing Officer
